The North Carolina Real Estate Commission's purpose is to protect the public when dealing with real estate brokers. The Commission has the power and authority to discipline any licensee if they violate the Commission rules or License Law.

As a new real estate agent, Alba is wondering what role the North Carolina Real Estate Commission (Commission) will play throughout her career. She wonders when the Commission was formed and who was a part of it. To answer Alba's questions and more, this lesson will explore the purpose and powers of the Commission, including the disciplinary authority it has.

What Is the North Carolina Real Estate Commission?

The Commission was formed back in 1775 as an independent state government agency. The primary function of the Commission is to license and regulate all real estate agents. This includes both firms and persons who lease, sell, and/or purchase real estate for others. The Commission also registers and regulates all sales activities of timeshare projects, where ownership is shared by many people in a single living unit, like a resort condominium. All real estate agents and timeshare salespersons need to be licensed as brokers.

Composition of the Commission

The Commission is comprised of nine members that serve terms of three years. The Governor appoints seven members, and the other two are appointed by the General Assembly after the Speaker of the House of Representatives and the President Pro Tempore of the Senate recommend them. There are some stipulations to membership:

  1. At least three members must be licensed brokers.
  2. At least two members must be 'public members' who are not in the real estate or appraisal business.

Purpose and Powers of the Commission

The main purpose of the Commission is to protect the interests of all members of the general public when they deal with real estate brokers. This is done by using the following statutory powers granted to the Commission:

  • Licensing brokerage firms and real estate brokers, and registering timeshare projects
  • Creating and administering pre-licensing education programs
  • Providing information and education related to the real estate industry
  • Regulating all business activity of brokerage firms and brokers, which includes disciplining those who violate the Commission rules or License Law.
